1. Acceptance of Terms

By accessing or using brettjohnson.co (the "Site") or placing an order with us, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the Site. If you do not agree to these Terms, do not use the Site.

We reserve the right to update these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Site following any changes constitutes acceptance of the new Terms.

3. Products

All products shown on the Site are subject to availability. We reserve the right to discontinue any product at any time.

Product descriptions, images, and specifications are provided in good faith and are as accurate as possible. Colours may vary slightly due to photography, screen calibration, and natural variation in materials. Minor variations from images do not constitute a defect.

Prices are shown in the currency displayed at checkout and include applicable VAT where required. We reserve the right to change prices at any time. The price applicable to your order is the price displayed at the time you place the order.

4. Orders and Payment

Placing an order: By placing an order through the Site, you are making an offer to purchase the relevant product(s) at the stated price. We reserve the right to accept or decline any order.

Order confirmation: An automated email confirming receipt of your order does not constitute acceptance. Acceptance occurs when we dispatch the goods and send a shipping confirmation email.

Payment: Payment must be made in full at the time of ordering. We accept major credit and debit cards and other payment methods displayed at checkout. All payment transactions are processed by our secure payment provider and are encrypted using SSL technology.

Order cancellations: If you need to cancel an order, please contact us at info@brettjohnson.co as soon as possible. Once an order has been dispatched, it cannot be cancelled and must instead be returned in accordance with Section 6.

5. Shipping and Delivery

We ship internationally. Delivery times and costs are displayed at checkout and vary by destination and service selected.

We aim to dispatch orders within the timeframes stated on the product page or at checkout. Delivery timescales are estimates and not guarantees. We are not liable for delays caused by customs clearance, carrier issues, or circumstances beyond our control.

Risk of loss and title for products passes to you upon delivery. If a package is lost or damaged in transit, please contact us at info@brettjohnson.co within 14 days of the expected delivery date.

International orders may be subject to import duties, taxes, and customs fees levied by the destination country. These charges are the buyer's responsibility and are not included in our prices or shipping costs.

6. Returns and Exchanges

Right of withdrawal (EU/UK customers): If you are a consumer located in the European Union or United Kingdom, you have the right to withdraw from your purchase within 14 days of receiving your order without giving any reason.

To exercise your right of withdrawal, notify us at info@brettjohnson.co before the 14-day period expires. You must then return the goods within 14 days of notifying us.

Return conditions: Items must be returned in their original, unworn condition with all original packaging, tags, and accessories intact. Items that have been worn, altered, washed, or damaged will not be accepted for return.

The following items are non-returnable:
Made-to-measure or personalised items
Items marked as final sale
Items returned outside the specified timeframe
Items that show signs of wear or alteration

Refunds: Upon receipt and inspection of returned goods, we will process a refund to your original payment method within 14 days. Original shipping costs are non-refundable unless the return is due to our error or a product defect.

Exchanges: We do not offer direct exchanges. To exchange a product, please return the original item (subject to the conditions above) and place a new order.

Defective or incorrect items: If you receive a faulty or incorrect item, please contact info@brettjohnson.co within 7 days of receipt with photographs and your order number. We will arrange a replacement or full refund including return shipping costs.

Return shipping: Unless the return is due to our error, return shipping costs are the customer's responsibility. We recommend using a tracked service as we cannot accept responsibility for returns lost in transit.

7. Intellectual Property

All content on the Site — including but not limited to text, images, photographs, look books, editorial content, videos, logos, and design — is the exclusive property of Brett Johnson or its licensors and is protected by international copyright, trademark, and design laws.

You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on the Site without our prior written consent. You may not use our trademarks, brand name, or logo in any way that implies endorsement, affiliation, or association with your business or products.

8. Use of the Site

You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You agree not to:

Transmit any unsolicited commercial communications or spam
Attempt to gain unauthorised access to any part of the Site or its infrastructure

11. Limitation of Liability

To the fullest extent permitted by law, Brett Johnson's total liability to you for any claim arising out of or in connection with these Terms or your use of the Site shall not exceed the amount paid by you for the product(s) giving rise to the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Site or any products purchased through it.

Consumer statutory rights are not affected by these limitations.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Italy. The courts of Milan, Italy shall have exclusive jurisdiction to resolve any disputes arising from or related to these Terms or your use of the Site.

If you are a consumer resident in the European Union, you may also have rights under the laws of your country of residence and may be able to bring proceedings in your local courts.

EU Online Dispute Resolution: The European Commission provides an online dispute resolution (ODR) platform for consumers: ec.europa.eu/consumers/odr (https://ec.europa.eu/consumers/odr). We are not obliged to participate in ADR proceedings but will consider reasonable dispute resolution requests made in good faith.

13. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
